There is nothing, absolutely nothing, that compares to the anguish that a parent suffers when his or her child has been negligently injured or killed. The negligent party and its insurance carrier is always says "we are so sorry" and then they say, "let's get this matter behind us" by offering you ten cents on the dollar to take care of an injured child for the rest of his or her life.

Did you know that in Mississippi a child under a certain age cannot be negligent under the law? That means that an adult has a duty while driving to take extra care when approaching a young child on a bicycle or walking or playing. It's the adult's fault, not the under aged the child's, when that child is struck by a moving automobile or simply turns into it's path. It is the adult's responsibility to foresee the actions of that child, be on the lookout and extra cautious. The fact that an adult has the right of way is no excuse. The fact that an under aged child is in a public street is no excuse. Likewise, the fact that a young child who trespasses and enters his neighbor's property through an unlocked gate that should have been guarding a swimming pool and drowned is no excuse. That swimming pool is a dangerous, attractive nuisance or trap that draws the mind of a young person towards it innocently. If a child under a certain age cannot be legally negligent, how can the child be trespassing?
